1. Acceptance of Terms of Service

Terms of Service define the agreement between VietHosting and its customers regarding service usage. By using the services provided by VietHosting, customers agree to comply with VietHosting's Terms of Service.

2. Service Management Account

A customer account on the customer management system https://clients.viethosting.com is an account created by the customer during service registration. The information required for account registration includes full name, address, email, phone number, and national identity card or passport number for individual customers or company/organization representatives, company/organization name, and business license number for corporate or organizational customers. This account will function to track service package information, invoices due for payment and service renewal, submit support requests, and utilize certain specific functions depending on the service.

Customers are responsible for maintaining the confidentiality of their login credentials. They should promptly update account information when there are changes, such as email, address, phone number, etc..

3. Payment and Renewal

Customers have the right to choose a suitable payment method, and service activation will be performed after we receive payment and confirm successful payment. VietHosting accepts the payment methods listed at https://viethosting.com/thanh-toan/

Service payments are prepaid to ensure uninterrupted service. For new service registrations, customers must pay the invoice within 48 hours. After this period, VietHosting will delete the order if payment is not received.

For service renewals, the system will automatically generate an invoice 10 days before the service expiration date to notify customers to pay in advance, avoiding service suspension due to late payment.

We reserve the right to refuse payment if we detect non-transparent payments or signs of fraud or illegal activities.

If customers pay via PayPal, they must accept that this payment method supports automatic service renewal. If customers cancel the service, they must ensure that they have turned off the 'Preapprove Payment' function from VietHosting in their PayPal account to avoid automatic payments at the billing cycle, even if the invoice has been canceled. This is a PayPal function beyond VietHosting's control, and we will not be responsible for it.

Customers are responsible for paying service renewals on time, or they should pay for service renewals between 7 and 10 days before the service expiration date. The service will be automatically suspended upon expiration, and after 7 days from the expiration date, if payment for service renewal is not received from the customer, the data will be completely deleted and cannot be recovered.

VAT (Value Added Tax) is a mandatory collection that we collect from customers to pay to the tax authorities. Customers are obligated to pay the taxes for each service. All service prices on https://viethosting.com do not include VAT.

4. Service Cancellation and Suspension

Customers may request service cancellation for any reason, and the request must be made through the system https://clients.viethosting.com

All customer data and services at VietHosting will be deleted upon service cancellation. Any remaining prepaid service fees will be processed according to the Refund Policy at https://viethosting.com/chinh-sach-hoan-tien/

Customers who wish to cancel the service after the registered period and do not want to receive renewal invoices for the next term must submit a service cancellation request with the 'End of Billing Cycle' option and must do so within 7 days before the service expiration date.

VietHosting may suspend services without notice for legal violations, breaches of service terms, or abuse. The service suspension period depends on the type of service and the extent of the impact. VietHosting is not responsible for any damages to the customer's business or any impact on the customer's data caused by the service package suspension.

VietHosting reserves the right to suspend service provision if payment is not received by the due date. Services will be resumed after the customer fulfills all payment obligations.

5. Customer Support

VietHosting offers customer support via phone, Telegram, and Zalo. For security-sensitive matters, such as login credentials, service passwords, or complex issues requiring extended processing, customers are requested to submit support tickets at https://clients.viethosting.com or send an email to support@viethosting.com.

5. Customers Responsibilities

Customers must securely store identification information, passwords, or other information related to their service account or customer management account and immediately notify us if they detect any unauthorized access to their account or security vulnerabilities, including loss, theft, or disclosure of passwords and other information.

Customers are legally responsible for their website content and must comply with legal authorities. Customers must comply with and be responsible for the regulations of the State and international regulations regarding the use of Internet services, state secrets, security, culture, intellectual property rights, and copyrights of operating systems and software installed on the server (if any).

Customers are responsible for independently maintaining data and source code on VietHosting's servers. We will not be responsible for cases of accidental data deletion or data loss caused by the user or the customer's security processes.

Customers are solely responsible for ensuring their website on the server is used for lawful purposes.

Customers are responsible for providing accurate information for individuals or organizations registering for services and must ensure that any related documents sent to us, such as ID cards, passports, etc., are accurate when requested.

Customers using the service must provide honest feedback on service quality across all media, websites, and forums. All feedback must be accompanied by verifiable evidence. We reserve the right to unilaterally terminate the contract if we find that the feedback is inaccurate, offensive, defamatory, and negatively impacts VietHosting's reputation.

When there are changes in service usage, such as user name, contact information, account number, or hosting domain name, customers must notify us by email or submit a support ticket on the Customer Management System at https://clients.viethosting.com.

6. VietHosting Responsibilities

VietHosting commits to providing services that adhere to the technical specifications outlined in the service package information at https://viethosting.com

VietHosting is responsible for providing client support throughout the service period, in accordance with the support policy specified in the terms of service for each respective service.

VietHosting is responsible for providing timely notifications to customers regarding service maintenance or changes.

VietHosting is responsible for fulfilling the commitments outlined in this document and related legal agreements.

VietHosting commits to refunding payments in the event of service discontinuation due to operational cessation.

VietHosting is responsible for ensuring the highest possible level of security to protect client data, except for newly discovered security vulnerabilities that lack patches from hardware or software manufacturers.

VietHosting commits to ensuring the integrity and confidentiality of client data, except when legally required to disclose client information to authorities.

In the event of hardware failure resulting in data loss, VietHosting is not liable, but commits to restoring data from the most recent server backup (if available).

7. Prohibited Uses of Service

VietHosting reserves the right to suspend services without applying a refund policy or refuse future service if there are violations of the usage regulations outlined in the "Prohibited Uses of Service" below.

Services must not be used for activities violating Vietnamese and international laws.

Services must not be used to disseminate content against the Socialist Republic of Vietnam, incite religious or political conflicts, distribute obscene materials, or affect Vietnamese customs and traditions.

Server services or server resources must not be used to distribute spam, advertising mail, or engage in large-scale email sending that affects the reputation of VietHosting's IP ranges.

Customers using VPS or Server services must adhere to Spamhaus regulations and recommendations to prevent VietHosting's IPs from being blacklisted. Any action that leads to VietHosting's provided IP ranges being blacklisted by Spamhaus, Barracuda, etc., will result in the customer's service being suspended and terminated without a refund for the remaining service period. The distribution and storage of malicious code for the purpose of attacking other websites or disrupting VietHosting's systems, such as Botnets, DDoS, Malware, Viruses, and Phishing, are prohibited. This includes cases where websites contain malicious code, are infected with malicious code, or are subject to large-scale DDoS attacks that severely impact the system.

Server services must not be used to host websites that impersonate individuals or organizations, causing damage to the honor and reputation of others.

The use of software that abuses bandwidth, CPU, and other server resources, such as Coin Mining or website traffic exchange software, is prohibited.

Websites must not be used to promote illegal services or products as stipulated in Decree 15/2020/NĐ-CP.

Service must not be used to store digital content that infringes copyright or intellectual property rights, or content that impersonates other organizations/individuals.

8. Limitation of Liability and Compensation

VietHosting's liability is limited as defined in this document, unless otherwise agreed. The customer is not entitled to waive liabilities under the terms stated herein.

If VietHosting fails to provide the committed service quality, compensation will be provided to the customer in the form of extended service usage time or a refund for the period of service unavailability. The compensation amount is determined by VietHosting and does not include any losses incurred due to service interruption affecting the customer's business.

9. Data Security and Information Confidentiality

VietHosting will not access customer data without explicit consent, except for legal requests.

VietHosting proactively implements measures to ensure the security of customer data within its capabilities, depending on the commitments of each service type. However, VietHosting shall not be liable for data security due to objective incidents such as natural disasters, fires, accidents, earthquakes, floods, embargoes, wars, actions of competent state authorities, or any other objective events that are unforeseeable and unavoidable, or due to subjective causes on the part of the customer.

10. Changes to Terms of Service
